Content Review and Unlawful Content
The Service Provider shall review orders from both a content and technical perspective before commencing production.
Where there are reasonable grounds to believe that the content provided or uploaded is unlawful, infringes the rights of a third party, or that you do not have the necessary rights or authorisation to use such content, the Service Provider shall be entitled to suspend or refuse production. In such circumstances, the Service Provider may contact you and provide you with an opportunity to demonstrate that you hold the necessary rights or authorisation. If you fail to provide such evidence, the Service Provider may cancel the order.
Where an order is cancelled due to unlawful, unauthorised or otherwise non-compliant content uploaded or approved by you in breach of these General Terms and Conditions, an amount of EUR 1.50 corresponding to the production preparation fee, shall not be refunded from the total purchase price, as consideration for the production preparation activities already performed. The production preparation fee is included in the product price stated on the relevant product page. The production preparation fee shall only be retained where the relevant production preparation activities have actually been carried out.
This shall not affect any statutory right of withdrawal or cancellation to which the Customer is entitled, or the exercise of such right. The remaining portion of the total purchase price, after deduction of the production preparation fee, shall be refunded in accordance with these General Terms and Conditions.
